Beneficiary - an individual, organization, group of persons, animals, project that receives a grant.
Campaign Creator - any legal person over 18 years of age who creates a Campaign through the Platform. The Creator has access to all functions and tools of the Campaign.
User – an individual, who uses the Campaign Platform and / or makes a donation on it.
Campaign - a cause created with the help of our platform, in order to raise funds from donors for personal causes or on behalf of the organization.
Platform - the website WWW.SOS4YOU.ORG and its adjacent communication interfaces, databases and functional modules, mobile applications.
Website - a collection of related web pages, photos, video content, texts and / or other digital resources that are accessible under a common unified address (URL) in an IP based network. For the purposes of these Terms, our website www.SOS4YOU.ORG will be called the Website.
Agreement, Terms - these General Terms, including the Privacy Policy and the Cookie Policy, which are an integral part of the Terms
Payment operator - the legal entity that provides electronic payments through the Platform of the Foundation.

The organization of Campaigns and the use of all functionalities of the Platform are possible only for registered users.

is not a payment institution, does not offer payment services, does not perform payment operations and does not provide services for which a license from a state body is required
is not responsible when using the Platform by the users, regarding the content, its accuracy and reliability, as well as the violation of the rights of third parties. Providing false or misleading information, as well as actions that do not comply with these General Terms and Conditions, may lead to the revocation of the rights of the respective user to access the Platform and its functionalities, without the Foundation being obliged to state specific reasons. Foundation may notify you via email specified by you during registration.

PROVISION AND USE OF THE SERVICE
To use the Platform and / or create a Campaign, you must be 18 years of age or older.
The Foundation is obliged to identify the donor and has the right to request documentary proof of this. In case of refusal, the Foundation may suspend the user's access to the functionalities of the Platform until it provides such proof.
You may use the service with or without registration, but access to all functionalities of the Platform is available for registered Users.
To register as a user in the Platform, you need to enter your first and last name, contact phone number, current address, email, which will be your username and password.
Registration can also be done by using a personal Facebook profile of the user, and when using this method of registration in the Platform, in order to be able to create a campaign, you must enter in your account a current contact phone number, otherwise case creating a Campaign will be impossible.
The responsibility for your account and the confidentiality of the password are entirely your responsibility. If you find an abuse, you must notify us immediately at support@sos4you.org.
As a user you undertake to use the Platform:
only for purposes permitted by applicable law, regulations or generally accepted practices, as well as by these Terms. Use it without violating our or other people's legal rights, protect it from damage, breakage or overload;
with the conditions for using the online payment system;
in accordance with the terms of Facebook, in case you register on the Platform through your Facebook account, which you can find at: https://www.facebook.com/legal/terms;
by not publishing personal contacts (phone numbers, e-mail, address) in the Platform when creating a Campaign, as well as in future updates;
by not publishing in the Platform bank accounts and other channels for transferring funds;
by not publishing in the Platform links to other fundraising websites;
from countries where its content is legal, and you are responsible for compliance with the laws in connection with your use of the Platform in the relevant territory to which you have referred it, and by accepting these Terms you agree to comply with all laws in connection with with e-commerce and donation of funds, transfer of personal data from the EU to third countries or to the country of your residence.
As a service provider, "SOS FOR YOU" Foundation provides the Platform for users in a completed form on a "as is" basis and is not responsible for unfulfilled expectations of the User.
"SOS FOR YOU" Foundation will not be required to satisfy the user's claims for changes in the characteristics and functionality of the service.
"SOS FOR YOU" Foundation is not responsible for the way the user uses the service and cannot guarantee accuracy, completeness and a specific deadline for response and response to requests for support from you. Support will be provided only on business days during our business hours, and we have the right to provide a new or improved version of the software without any commitment to add specific functionality, support or changes to the software used to make it accessible and usable. for you.

The platform may not be used to violate good manners with offensive, threatening, obscene, hateful or pornographic elements, sexually oriented materials or services.
The platform may not be used for the purpose of offering, selling and distributing shares, bonds or other securities, real estate, insurance, banking or financial services, including the granting of loans.
The platform may not be used for the purpose of offering, selling and distributing weapons, ammunition, firearms, knives, accessories that are released with a permit for use, objects that pose a risk of injury, death, damage or destruction of property, items that infringe someone else's intellectual property rights, privacy rights, or improper disclosure of confidential information and personal data.
The platform may not be used for the purpose of participation, support, promotion and engagement of activities that contradict the laws of the Republic of Bulgaria, as well as foreign legislation, including infringement of foreign intellectual property rights of third parties and / or the right to confidentiality by disclosing or using such information.
The platform may not be used to promote terrorism, violence, defamation, hatred, bodily harm, property damage, violence, racial intolerance or financial exploitation, to cause a risk of or actual bodily conflict, damage, material or non-material damage, defamation .
The platform cannot be used for gambling, including betting, lottery, raffle, "pyramid" or similar scheme, as well as other games of chance.
The platform may not use unauthorized self-promotion, use widgets on the site with content that is contrary to or in violation of these Terms, to collect personal data about others (including email addresses or other personal information) without their consent, to take action that imposes or may impose an unreasonably or disproportionately heavy load on the infrastructure or may have devastating consequences; uploading, publishing, using computer viruses, trojans or other malicious programs and systems that interfere with or are capable of interfering with the normal operation of computer systems and / or that may make the use of WWW.SOS4YOU.ORG dangerous for the User.
The Platform cannot be used to send "spam" or use an automated system to access the Platform in a way that sends more messages to the servers of WWW.SOS4YOU.ORG than one can produce in the same period of time using a conventional web browser, to attempt to interfere with or compromise the integrity of the system or security, or to decrypt transmissions to or from the servers, or otherwise compromise the operation of the Platform by suspending access to it, to present another person or fraudulent identification with a person or organization, including concealment of identity, to share false or misleading posts - including false or misleading information in the Campaign, in the profile, and in comments (for example, by distorting the description of the Campaign or the purpose of the Campaign ).
Notwithstanding the above, by using the Platform you accept and agree that WWW.SOS4YOU.ORG has the right in its sole discretion:
to verify you and your data as a user of the Platform;
to edit the content provided by you and its format when creating and describing a Campaign in order to provide more accessible, acceptable and understandable for users content;
permanently or temporarily terminate, suspend or otherwise refuse to authorize your access to the Platform or remove any Campaign, opinions or other content, as well as block any natural or legal person in case of suspicion of violation of these Terms.
The lists described above are not exhaustive, and WWW.SOS4YOU.ORG reserves the right to investigate any person and to restrict or temporarily or permanently revoke their access to the Platform in the event of a suspected violation of the Terms.
WWW.SOS4YOU.ORG reserves the right to remove any content that is contrary to law, morals and good manners and that may be considered offensive or misleading by blocking or deleting the profile of the person who generated such content, and terminating donations and distribution of the funds raised under the Campaign organized by him.
In the event that the creation of a Campaign is established through misuse and misrepresentation of its objectives and / or Beneficiary, or misuse of donated funds, Donors have the right to request a refund of the amount donated by them under this Campaign, or to indicate another active Campaign to which the funds already donated by them will be reallocated, according to the mechanism described below.
In the event that abuse is found in the spending of funds raised under a Campaign, WWW.SOS4YOU.ORG will notify the Donors who supported this Campaign, for the presence of abuse, to the e-mail address indicated by them during registration, within 7 days from the date of notification.
Donors have the right to indicate:
• whether they want the money donated by them under this Campaign to be reimbursed to them. In case the Donors wish to be reimbursed, WWW.SOS4YOU.ORG will fully refund the donated funds up to the amount of € 1000 per Donor for a Campaign, without incurring additional costs for the Donors related to the transfer of the amount.
• to which other active Campaign to redistribute the funds donated by them. In the event that the Donors do not exercise their right to choose under the previous sentence within the given period, WWW.SOS4YOU.ORG will redistribute the funds to a Campaign of their choice.
Abuse occurs when:
the funds are spent for purposes that are not related to the Campaign and / or contradict these Terms;
the description of the Campaign is misleading;
The Creator or Beneficiary of the Campaign is accused of a crime that casts doubt on the veracity of the information published in the Campaign.
Donors are NOT entitled to claim a refund of their donated funds in cases where:
the funds have been transferred under own campaign;
the funds have been transferred to a bank account with a holder other than the "SOS FOR YOU" Foundation;
personal disagreements have arisen between them and the Creator or the Beneficiary of the Campaign;
for some reason they regretted supporting a Campaign.
The Foundation reserves the right to demand reimbursement of the amounts returned by it from the persons whose actions have led to abuses, which gave rise to the return of the donated funds, including through court.
You agree that we may perform the above actions without notice and without the need to consult third parties, and we shall not be liable for any damages resulting therefrom. Until the eventual termination of the relationship between you and the Foundation, you remain bound by these Terms and are obliged to comply with the rules governing the lawful use of the Platform.
STARTING A CAMPAIGN
Each Campaign should have a title, description and purpose for raising certain funds.
A campaign can be launched both to raise funds for the benefit of the Creator of the Campaign and to raise funds for the benefit of a third party. The existence of Campaigns is not tied to deadlines, but to achieving the goal set by the campaign. A campaign creator has the technical ability to stop the campaign and fundraising on it himself, when he considers that the need to collect them has already disappeared. In the general case, the Platform automatically stops the campaign and stops collecting funds for it when the set goal is reached as an amount.
Each Creator of the Campaign declares and guarantees that the information provided by him is accurate, complete, reliable and there is no danger of misleading the users, as well as that all donations made under the Campaign created by him will be spent only for those specified in it. purposes (in cases where the Creator of the Campaign also has the status of Beneficiary and / or Beneficiary). When creating a Campaign in favor of a third party, a notarized document certifying the authorization to represent a third party is required.
The Creator of the Campaign is obliged to keep the information about the Campaign up-to-date, informing the Donors in due time, in case of change of the circumstances under which the Campaign was created, as well as to observe the applicable legislation and the present Conditions when using the Platform and raising funds. .
The Creator is responsible for the information submitted for the approval of the Campaign, agreeing before publication and on the website to check it, to make design changes if necessary in order to optimize, structure the content and its description by the Foundation, in order to provide more accessible, understandable and acceptable by the user content.
The Creator of the Campaign has the right to make changes to the created Campaign at any time, observing the provisions of these Terms. Subsequent changes to the Campaigns are not subject to approval for publication by an administrator of the Platform, but the Foundation reserves the right to request additional adjustments.
In order to keep a campaign active, it is required to provide up-to-date information through texts, photos, videos and media materials for events related to the Campaign.
The users of the Campaign have the obligation to periodically make publications on the Campaign website (messages, photos, videos, updates of what has been achieved so far, etc.) in order to keep the information about their Campaign up to date, as well as to inform their donors about the development. of the campaign.
DONORS
When you make a Donation through the Platform, it is your responsibility to find out how and for what the funds donated by you will be spent. "SOS FOR YOU" Foundation is not responsible for any offers, invitations, offers or prizes made or promised to you by Campaign Creators, Beneficiaries and / or third parties. The responsibility for making donations is entirely yours.
You can make a donation by directly supporting the Campaign of your choice in the following ways. For each amount transferred by you, you will be issued a donation certificate and a donation contract concluded between you and the Foundation, and you have access to them in the account created by you in the Platform.
Donors have the right to make the gratuitous donation anonymous by explicitly choosing this method before supporting their chosen Campaign. Anonymity cannot be applied to the Foundation, which must always be able to establish the origin of donations. Upon request, the Foundation may provide access to the names of donors to state bodies or institutions that have a legal right to do so. In all other cases, the name and other personal data of the donors who have chosen anonymity remain inaccessible to the users of the Platform.
In order to ensure security and accountability to the donors that the donated funds will go to the benefit of the beneficiaries, all received donations under Campaigns are collected in a bank account of the "SOS FOR YOU" Foundation. Donations in favor of the beneficiaries are made to the Foundation, and the donor chooses to which Campaign he wants the funds donated by him to be directed. The foundation distributes donations to a bank account specified by the Creator of the respective Campaign, in accordance with the distribution of funds specified in these Terms, and the fundation reserves the right to refuse payment if it contradicts the goals of the Campaign.
The platform WWW.SOS4YOU.ORG supports the following payment methods:
debit or credit cards (Visa, MasterCard and other bank cards);
direct bank transfer.
In the process of making a donation, apart from the amount donated by you under the Campaign, you can also make an additional donation in favor of the "SOS FOR YOU" Foundation in an amount determined by you, which cannot be less than € 1.
In the event that the amount specified by you for a separate donation to the Foundation to support its existence and development is:
5% or more of the value of the donation made by you under a Campaign, the entire donated amount under the Campaign will be credited to the Beneficiary after deducting the costs for processing bank card payments;
when there is no separate donation to the Foundation, 5% of the amount donated by the Campaign in favor of the Foundation is deducted so that the Foundation can cover its costs for the maintenance of the Platform, as well as so that we can continue to provide our services to help other future causes in need.
When making a donation, the donor should provide information about his bank card or other necessary information related to the transfer of the amount of money, as the data from the bank cards are not visible by the Foundation and are not stored on our server. Only the licensed card operator processing the payment has access to this information.
As a donor, you warrant that the information you provide is correct and that you have the right to make the payment. You agree that some donations may require a minimum amount and that all payments are final and non-refundable, except as provided in these Terms.
You also have the opportunity to support a Campaign by making periodic monthly donations. In this case, you agree that the amount specified by you will be deducted from your bank account on a monthly basis until the end of the Campaign or until the withdrawal of your consent to make periodic payments. You can do this from functionality in your account in the Platform, and if necessary you can contact us for assistance.
As a donor, you agree to update your account information in the event of changes (eg change of your card or the expiration date) and authorize the "SOS FOR YOU" Foundation to charge your payment instrument every 30 days.
DISTRIBUTION OF FUNDS
The Foundation distributes the received funds to the Campaigns of your choice as follows:
up to 2.9% + € 0.30 are fees for processing bank card payments, which are charged by the online payment system we work with, in accordance with their terms;
when there is no separate donation to the Foundation, 5% of the amount donated by the Campaign in favor of the Foundation is deducted so that the organization can cover its costs for the maintenance of the Platform, as well as so that we can continue to provide our services to help other future causes that need support. The "SOS FOR YOU" Foundation covers the costs of its existence entirely with the help of donors, and no profit is distributed from the donations to the foundation itself.
After deducting all costs of the Campaign, the donated funds are transferred to the beneficiary's bank account specified by the Creators of the Campaigns, deducting the relevant bank fees, as well as the costs of advertising to promote the cause in order to increase fundraising efficiency of the necessary funds, by which the donors, the creators of the Campaigns and the beneficiaries expressly agree to the acceptance of these Terms
By accepting these Terms, donors agree that in the event of closure of a Campaign for a reason beyond the limits described above, in cases of termination due to abuse before its objectives are achieved and before the amount specified therein is collected, the funds collected under it remain unallocated, the donated amounts will be redirected to another or other active Campaigns, indicated by the beneficiary of the Campaign, or by the Foundation.
The redirected funds under the already closed Campaign should be of the same category or of the Medicine category.
The foundation redirects the funds to the other Campaign indicated by the Beneficiary within 30 calendar days from the date of closing of the first Campaign. In case within 30 days from the closing of the Campaign the User does not indicate, in writing or electronically, to which other in the current Campaign to reallocate the remaining funds, the "SOS FOR YOU" Foundation will make this choice at its discretion.
By accepting these Terms, donors agree that in the event of closure of a Campaign for any reason, including the restrictions described above, in cases of termination due to abuse, the amount donated to the "SOS FOR YOU" Foundation in addition of the donation made by the donors under the Campaign, is not subject to return of the latter.
BENEFICIARIES AND ASSETS OF FUNDS
Beneficiaries of the Campaign, who wish to be allocated funds for absorption, of all or part of the amount raised under their Campaign, must indicate the amount of funds and provide the relevant documents in this regard, proving the need for funding.
The "SOS FOR YOU" Foundation, in its sole discretion, reserves the right to refuse or change the application by granting an amount other than the requested amount, as well as to transfer part or all of the amount directly to the account of third parties (hospitals, medical institutions). establishments and others) to achieve the goals of the Campaign.
An obligatory condition for the existence of the Campaign is accountability. The Creator of the Campaign and / or the Beneficiary owes a report on the amount and manner of spending the funds, which is sent to support@sos4you.org, for the achievements with the received donations, an inventory of the documents for expenditure (invoices, contracts or other documents) and visual material - photos or video or other materials. Documents can be uploaded in the Platform to any campaign by the Beneficiary.
The foundation has the right to carry out an additional inspection.
TAX ASPECTS
It is the responsibility of the users to check whether and what taxes are applicable to the donations they receive through the use of the Platform.
It is the sole responsibility of the users to check, collect, report and transfer the necessary tax to the tax authorities.
By using the Platform and charging a tax on donations that are collected and distributed, the "SOS FOR YOU" Foundation is not responsible for this, nor can it give advice in this regard.
In case of ambiguity regarding the due, basis and amount of the applicable tax, ask your accountant or lawyer.
INTELLECTUAL PROPERTY
OUR RIGHTS
The content of the Platform is protected by the applicable regulations in the field of intellectual property. It is owned by the "SOS FOR YOU" Foundation or used by the latter under a license or permit.
All intellectual property rights of the software used to provide the Service, the Website and its content, data files, hardware or other materials such as analyzes, plans, documentation, reports, offers and other intellectual property objects to which you have access using of the Platform and on the basis of these Terms, except for your content, we will leave it exclusively to us, our licensors and our own suppliers. All rights of use granted to you will be non-exclusive and non-transferable to third parties and are not subject to sublicensing. You will not be permitted to remove or modify any details regarding copyrights, trademarks, names or other intellectual property rights of the Software, the content of the Platform also covers (including, but is not limited to) all texts, the formatting, selection, coordination, arrangement and design of the Website, as well as images, graphics, tools, applications, textual content, photographic images, trademarks (including those requested with an incomplete registration process), trade names, logos, and other materials and information posted on the Platform.

You also grant each Platform User the non-exclusive right to access, use, download, store, broadcast, transmit, publicly display or print your materials through the Platform in order to promote the Campaign, as well as to use, comment, reproduce, distribute and perform these materials.
You have the right to terminate your registration at any time without reason, sanction or explanation. When you delete your user content, it will be removed from your account, but certain user content will remain available, any of your republished content will not be removed and will continue to be used in accordance with these Terms and will exist as a backup for a certain (limited or unlimited) period of time, for technical or accounting reasons, although it will not be visible to other Users.
The content you delete may continue to exist and appear if it has been shared by other users and they have not deleted it.

By accepting these Terms, you agree to the "SOS FOR YOU" Foundation's Privacy Policy and the right to be processed by the Foundation in accordance with the regulations.
The user guarantees that all requirements regarding the lawful processing of personal data entered and processed by the User in the Platform are met. The user is fully responsible for the personal data processed by using the service by him. You guarantee that the data is not illegal and does not infringe the rights of third parties.
APPLICABLE LAW AND JURISDICTION
It is attached to this Agreement and shall be interpreted in accordance with the provisions of the law of the Republic of Bulgaria. The Parties agree that the Bulgarian courts shall have exclusive jurisdiction in resolving any legal dispute or matter arising out of or in connection with this Agreement.
Disputes arising in connection with this Agreement which are the subject of international private law relations shall be settled by the competent national court.
For all issues not settled in these Terms, the relevant provisions of the current Bulgarian legislation should be applied.
The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
Applicable to any disputes between the "SOS FOR YOU" Foundation, on the one hand, and the Beneficiary, on the other, will be the law of the Republic of Bulgaria, and if no agreement can be reached between the parties, the dispute should be referred to the competent Bulgarian court.
The law of the Republic of Bulgaria will be applicable to any disputes between the parties concerning private law relations with an international element, as the parties provide exclusive competence for their resolution to the Bulgarian courts.
RESPONSIBILITY
The Foundation does not have the objective ability and obligation to control the way the user uses the Platform.
The user uses the Platform at his own risk, agreeing that the Foundation is not responsible for direct and / or indirect property and / or non-property damages and / or lost profits arising from access or terminated and / or interrupted access of the user to the WWW .SOS4YOU.ORG, as well as for any other damages incurred in connection with the use of the Platform by the same, including the way in which the Platform could affect the user.
The Foundation does not guarantee that the Platform is continuously and at all times protected, safe, functioning properly without interruption and without the presence of other problems related to its use by users.
The Foundation is not responsible for the lack of access to the Platform, as well as for the impossibility of processing or untimely processing of applications for making or receiving a donation, in circumstances beyond its control in cases of force majeure, accidental events, problems in the global Internet and in the provision of services beyond the control of the Foundation.
The Foundation is not responsible for possible delays, restrictions, disrupted or missing communications resulting from the customer's Internet subscription. The Foundation is not responsible for the Internet connection of the user.
The Platform may contain links to other websites owned and maintained by third parties other than the "SOS FOR YOU" Foundation, and you agree that these links are provided for convenience only and the Foundation is not responsible and in no way responsible. is bound by the content of these websites, not guaranteeing the accuracy of the information provided in them, description of services, protection of personal information provided by the user, etc. If you have any questions about the information on these websites, as well as how to use them, you should contact the owners and administrators of these websites directly.
Insofar as it does not have the objective possibility and obligation and does not control the websites and resources made available through the hyperlinks placed on the Website, the Foundation is not responsible for the illegal nature of the content and materials located on these websites and resources. The Foundation shall not be liable for damages caused to software, hardware or telecommunications equipment, or for loss of user data caused by materials or resources sought, downloaded or used in any way through the Website.

In the event that any of the above limitations and exclusion of liability by the "SOS FOR YOU" Foundation is not permitted by law, its liability should be considered excluded / limited to the fullest extent permitted by the applicable law.
GENERAL PROVISIONS
By your presence and use of the Platform, it is assumed that the user has read these General Terms, agrees with all their provisions and undertakes to comply with them unconditionally. In case of disagreement, the user should terminate the use of the Platform immediately.
The user undertakes to use the Platform in good faith and as intended, in compliance with all applicable laws, and undertakes not to use software, scripts, programming languages or other technologies that could create difficulties in the operation and use of the Platform.
The user agrees that these General Terms and Conditions do not impose any obligations on him, except those explicitly described here and arising from the law. The Parties agree that in the event that any of the clauses in these General Terms and Conditions prove invalid, this will not lead to the invalidity of the General Terms and Conditions as a whole or other provisions thereof. The invalid clause will be replaced by the mandatory norms of the law or the established practice.
